Tarot Reading Services - Terms and Conditions

When visiting Eva Juliette’s website, social platforms or making a purchase, you agree to the following terms and conditions. Please read these carefully before using Eva Juliette’s products/services.

Eva Juliette Pty Ltd (“Eva Juliette”) and the Client (“You”) agree to the following Terms and Conditions of Sale (“Terms and Conditions”). These terms and conditions prevail over any other terms and conditions provided and apply to Tarot services provided by Eva Juliette to you.

Services

1. The Tarot services provided by Eva Juliette are as described on the booking page, or for group bookings as contained in the invoice provided by Eva Juliette(“Services”).

2. Tarot services provided by Eva Juliette are designed to encourage reflection, they are not a prediction of the future.

3. The services are provided for entertainment purposes only and do not constitute or replace professional advice, legal, health or financial advice. You should seek guidance of a qualified professional.

Exclusions

4. To book these services, you must be 18 years or older. Eva Juliette reserves the right to refuse to provide the services to a minor.

5. Eva Juliette does not provide sessions or readings about the following topics:

a. Legal issues

b. Health and pregnancy

c. Finance

d. Third parties (e.g. people who are not you)

e. Spells or curses

6. Eva Juliette may reframe or re-direct any questions or decline or terminate a reading if you ask questions about these topics.

Group & Event Bookings

7. Group bookings (more than 1 person or animal) cannot be made through the website, for all group booking enquiries please contact Eva Juliette on hello@evajuliette.com.au

8. These terms and conditions apply to both online and group and event bookings.

Pet Bookings

9. For all pet bookings, please ensure you select a pet session when making the booking.

Price & Payment

10. The price for the services varies based on the particular service provided. Prices are listed on Eva Juliette’s website and booking page.

11. For group and event bookings, an invoice for the price will be provided by Eva Juliette at the time of the enquiry. The price must be paid in order to secure the booking date.

12. Payment of the price is required upfront at the time of booking the services in order to reserve the date and time of the session.

13. Payment of the price constitutes acceptance of these terms and conditions.

Cancellation & Refunds

14. Except as required by law, Eva Juliette is not obliged to refund the services if you choose to cancel the booking. Eva Juliette may elect to reschedule the services for a time convenient to both you and Eva Juliette.

15. If you need to reschedule your booking, please reschedule through the booking page on Eva Juliette’s website at least 48 hours prior to the session time. Rescheduling is subject to the availability of Eva Juliette.

16. If you need to reschedule within 48 hours of your booking, please contact Eva Juliette directly on hello@evajuliette.com.au

17. If you do not attend your scheduled session ("no show"), you will not be entitled to a refund of the Price. Rescheduling is at the discretion of Eva Juliette and subject to availability.

18. The Australian Consumer Law may give to you certain guarantees. Where liability for breach of any such guarantee can be limited, Eva Juliette’s liability (if any) arising from any breach of those guarantees is limited with respect to the supply of the Services, to the cost of re-supplying the Services again.

Termination

19. Eva Juliette reserves the right to terminate the services at any time during a session if:

a. You breach these terms and conditions

b. You appear to be under the influence of alcohol or drugs

c. You behave inappropriately or in a manner that makes Eva Juliette uncomfortable.

20. If you are in breach of these terms and conditions and the session is terminated, Eva Juliette may retain the Price, and you will not be entitled to a refund.

Confidentiality

21. Any information provided to Eva Juliette in a session will be kept confidential unless required to be disclosed by law, in the public domain or in the interest of personal or public safety. For example, if you disclose that you intend to harm yourself or others.

22. Virtual or in person sessions cannot be recorded or photographed without the express prior consent of Eva Juliette.

Liability

23. If Eva Juliette is unable to perform the services due to illness or other circumstances beyond their control, Eva Juliette is free from any obligation to provide the services while those circumstances continue. Eva Juliette may elect to:

i. reschedule: or

ii. refund your payment;

iii. terminate this agreement and if terminated Eva Juliette will have no further liability to you for any loss, damage or claim arising out of this agreement.

24. Circumstances beyond Eva Juliette’s control may include but are not limited to, illness, government orders, fire, storms and other natural disasters and IT, network and telecommunications outages.

25. You indemnify and keep indemnified Eva Juliette, its servants and agents in respect of any claim or demand made or action commenced by any person against Eva Juliette or, for which they are liable, in connection with any loss or damage arising from or incidental to the provision of the Services, except if the claim or demand has arisen because of the action or omission of Eva Juliette.

26. To the extent permitted by law, you release Eva Juliette from all claims, demands, actions, liabilities and damages of any kind, whether directly or indirectly arising from or related to the services provided by Eva Juliette. Nothing in this clause excludes any rights you may have under Australian Consumer Law.

27. Eva Juliette is not liable for any indirect, incidental or consequential damage or loss resulting from the services.

28. Eva Juliette is not liable for any actions taken by you or the consequence of those actions; they are your sole responsibility.

Subscriptions

29. For monthly or quarterly Tarot session subscriptions, Eva Juliette will bill you automatically each month/quarter on your original sign-up date (“Scheduled Payment”).

30. By subscribing you authorise automatic monthly/quarterly charges to your payment method unless you cancel in accordance with these terms.

31. If you want to cancel your subscription you can do so at any time with no cancellation fees, with at least 2 weeks prior to the next Scheduled Payment (“Notice Period”).

32. If you cancel your subscription within the Notice Period, you may still be charged for that month’s/quarter’s payment.

33. If a Scheduled Payment cannot be processed using your payment method, your subscription will be automatically cancelled.

Intellectual Property

34. Intellectual Property Rights means intellectual property rights at any time protected by statute or common law, including copyright, trademarks, patents and registered designs.

35. All Intellectual Property Rights including any moral rights in any materials created by Eva Juliette vest in and remain the property of Eva Juliette. This includes but is not limited to voice notes and written readings.

36. Eva Juliette does not permit you to download, reproduce, display, publish, transmit, distribute, copy, print or edit any material provided for public, commercial or personal use without her written permission.

37. The obligations accepted by the Parties under these Intellectual Property clauses survive termination, completion or expiry of this agreement.
